Allegations
In this class action lawsuit, the Named Plaintiffs alleged that Auto Market charged them deceptive fees (listed as “Dealer Processing Charge” and “ADMIN FEE”) in violation of Maryland law. Specifically, the we alleged that 1) The “Admin Fee” is really a disguised Dealer Processing Charge, 2) Auto Market charged for than the $300 statutory maximum Dealer Processing Charges, and 3) None of these fees were disclosed to consumers in advertisements or on the window stickers (as required by law).
Class Definition
All natural persons who, in the three (3) years preceding the filing of this action:
- Purchased a vehicle from Auto Market;
- Registered the vehicle with the Maryland Motor Vehicle Administration;
- Was charged an “ADMIN FEE” and/or “Dealer Processing Charge” and/or any other fee charged by Auto Market within Maryland’s definition of “Dealer Processing Charge”; and
CLASS A
- The sum of such charges in (b) above is greater than $300.00,
or
CLASS B
- The sum charges in (c) above were not disclosed on the price statement attached to the window of the vehicle, above the total price in at least 10 point font.
